Types of Information CollectedUser Provided Information
OffMarket collects information about users when they complete the member registration process. During registration, each user is required to provide contact information (name, position/role, company name, street address, telephone number, email address, property types, and regional focus, etc.). We require a member to have a unique username and password to restrict access to confidential information and rights to revise or update information that member previously posted. OffMarket collects financial and billing information, such as billing addresses, credit card numbers, expiration dates, and security codes, for billing payment and credit card authorization and payment purposes only. OffMarket also collects information provided to us by users that pertain to properties that are posted to OffMarket. Some of that information may, could or will be available to all users. The member, who has posted the property information, may restrict other members from obtaining access to certain information about the property at their own discretion. If a user corresponds with OffMarket via email, we may retain the content of the message, your email address and our response.
OffMarket may place a cookie, which is a small text file containing a string of alphanumeric characters, in the browser files of a user’s computer in order to uniquely identify the user’s browser and let OffMarket help the user log in faster, enhance their navigation through the site, and provide automated features. A cookie may also convey anonymous information to us about how the user browses the Service. A cookie does not collect personal information about the user. OffMarket uses or may use both session and persistent cookies. A persistent cookie remains on a user’s hard drive after they close their browser. Persistent cookies may be used by the browser on subsequent visits to the site. Persistent cookies can be removed by following the web browser's directions. A session cookie is temporary and disappears after the browser is closed. You can reset the web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly if the ability to accept cookies is disabled.
Log File Information
Log file information is automatically reported by the user’s web browser each time they access a web page. When a user accesses OffMarket, our servers automatically record certain information that the user’s web browser sends whenever you visit any website. These server logs may include information such as the user’s web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information.
Clear GIFs Information
When a user uses OffMarket, we may employ clear gifs (also known as web beacons) which are used to track the online usage patterns of our users anonymously. No personally identifiable information from your OffMarket account is collected using these clear gifs. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make OffMarket better for our users.
Third Party Services
Use of Information Collected
Collected information is used by OffMarket to validate a user’s subscription, to provide the appropriate services to the member, to maintain their member profile, and to include and later edit information on their properties. Email addresses are used to communicate with members through property marketing emails, promotional emails, and for site administration purposes. Users may be deleted from property marketing and promotional email lists at their request. Personal information may be used to contact users for the purpose of research, product development, marketing, or customer service, if the user has opted to receive such communication.
Financial information is used to bill users for subscription services or products purchased. This information is only available to OffMarket’s accounting managers and third-party payment processor. IP address and cookie log data is analyzed to better understand traffic flows and user preferences. OffMarket may retain the data it collects indefinitely. Users may have their personal information deleted or deactivated by sending an email to firstname.lastname@example.org. Users may be asked to confirm their identity.
Following termination or deactivation of a User’s account, OffMarket may retain the user’s profile information and user content for a commercially reasonable time for backup, archival, or audit purposes, subject to any applicable privacy settings. Furthermore, OffMarket may retain and continue to use indefinitely all information (including user content) contained in the user’s communications to other users or posted to public or semi-public areas of the Service after termination or deactivation of the user’s account.
If a user chooses to use our invitation service to invite a colleague to the Service, OffMarket will ask you for that person's email address and automatically send an email invitation. OffMarket stores this information to send this email, to register the colleague if the invitation is accepted, and to track the success of our invitation service. Any invited user may contact OffMarket at email@example.com to request that we remove this information from our database.
All user information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without the user’s consent, other than for the express purpose of delivering the purchased product or service requested.
How We Share Your InformationPersonally Identifiable Information
OffMarket shares user information in the following areas on the site: Property Marketing Service and Professional Directory. When a user enters a sale listing in the Property marketing Service, contact information is also entered. Other users can view the contact information provided by the listing user when they view the property marketing profile. Additionally, a Property Marketing user will be able to view the profile information of each user that signs the Confidentiality Agreement for the property.
Key billing information (such as credit card number, expiration date and dollar amount) gathered from users making online purchases of products or services is shared with our credit card processing partner in order to authorize charges to the credit card. OffMarket also uses third party providers to send Property Marketing emails on behalf of OffMarket, but this information (such as the name, address and email) is confidential and is not used by the provider for any other purpose.
We may sell to, merge or affiliate with another person or sell assets owned or controlled by Us. The identity of Members, emails, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign such information in the course of corporate divestitures, mergers, or dissolution.
Any personal information or content that you voluntarily disclose for posting to OffMarket, such as user content, may become available to the public, and may be controlled by applicable privacy settings. To change your privacy settings on OffMarket, view your Account Settings page. If you remove information that you posted to the Service, copies may remain viewable in cached and archived pages of OffMarket, or if other users have copied or saved that information.
Non-Personally Identifiable Information
We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to help them understand the usage patterns for certain OffMarket services.
How We Protect Your Information
OffMarket's users and their personal information are considered to be OffMarket's greatest asset and thus their privacy is treated with the utmost regard and respect. OffMarket takes every reasonable precaution to secure personal information within both its computers and its physical premises.
The security of our users’ personal information is important to OffMarket. When a user enters sensitive information (such as a credit card number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL) and then encrypted into our payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.
OffMarket follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet or method of electronic storage is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Your Choices About Your Information
OffMarket utilizes email as a vital and primary communication channel with registered users and customers. As a registered user, you hereby acknowledge and grant OffMarket the permission to communicate with you via email (as well as other communication channel such as phone and fax) for any purposes OffMarket determines to be relevant including, but not limited to, system messages, product updates, service announcements and other marketing messages. OffMarket will use best efforts to honor customers request to opt-out of marketing messages, but under no circumstances will OffMarket have any liability for sending any email to its registered users.
Users who do not wish to receive marketing emails are requested to contact OffMarket via email, or select the opt-out option by deselecting the email option from their member profile. We also send our users site and service announcement updates. Users are not able to un-subscribe from service announcements, which contain important information about service notices and responsibilities. OffMarket occasionally communicates with its users via email and phone to provide information about requested services and regarding issues related to their account. It is important to note that this communication is not used for marketing or promotional purposes. Requesting the deletion of certain types of user information may prevent users from accessing some web site features.
Because OffMarket values our users’ privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. As part of the California Online Privacy Protection Act, all users of our site may make any changes to their information at anytime by logging into their account and editing their profile.
Subscriptions will automatically renew using the user's current credit card account number unless the user cancels their subscription on the OffMarket web site at thirty (30) days prior to the renewal date to cancel such subscription. All cancellation requests will be processed within five (5) business days. Once the cancellation is processed, a confirmation email will be sent via the customer's email account on record with OffMarket. If user has a question about a cancellation, they should contact OffMarket at email@example.com or at 877-721-6901. OffMarket reserves the right to change its fees or billing methods at any time. OffMarket will provide timely notice to the affected users of any such changes.
We will retain user information for as long as their account is active or as needed to provide them services. If a user wishes to cancel their account or request that we no longer use their information to provide services contact us at firstname.lastname@example.org. We will retain and use a user’s information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Compromise of Personal Information
Protecting the privacy of young children is especially important. As such, OffMarket is in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act). OffMarket does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register as Members. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to or on OffMarket. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at email@example.com.
OffMarket may provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to users via email notice, written or hard copy notice (including via fax), or through posting of such notice on our website, as determined by OffMarket in our sole discretion. OffMarket reserves the right to determine the form and means of providing notifications to our users, provided that you may opt out of certain means of notification as described herein. OffMarket is not responsible for any automatic filtering a user or their network provider may apply to email notifications we send to the email address provided to us.
